PUBLIC HEALTH ACT 2010 - SECT 39 Secretary may give training directions relating to skin penetration procedures PUBLIC HEALTH ACT 2010 - SECT 39 Secretary may give training directions relating to skin penetration procedures 39 Secretary may give training directions relating to skin penetration procedures (1) The Secretary may serve on a person found guilty of an offence under this Act or the regulations in relation to the conduct of a skin penetration procedure at premises a notice-- (a) directing that the person undertake specified training, and (b) prohibiting the carrying out of specified skin penetration procedures at the premises until the training is completed. (2) A person who-- (a) is subject to a direction or prohibition under this section, and (b) has notice of the direction or prohibition, must not, without reasonable excuse, fail to comply with the direction or prohibition. : Maximum penalty--1,000 penalty units or imprisonment for 12 months, or both.
