PUBLIC HEALTH ACT 1991 - SECT 8
Closure of premises
(1) If the Minister considers on reasonable grounds that any premises on which
the public, or sections of the public, are required, permitted or accustomed
to congregate should be closed in order to preserve the health of the public,
the Governor may, by order published in the Gazette, direct that the premises
be closed, and kept closed, in accordance with the order while it is in force.
(2) If: (a) a direction given under this section is in force in relation to
premises that are not under the control of a Minister, and
(b) a person who
controls, or is involved in the control of, the premises is notified of the
direction,
the person must take such reasonably practicable action as may be
necessary to ensure compliance with the direction.
(3) A person who, after
being notified under subsection (2) of a direction given under this section,
fails to comply with that subsection is guilty of an offence. Maximum penalty:
50 penalty units or imprisonment for 6 months.
