Medicines to be dispensed by pharmacists
36AA Medicines to be dispensed by pharmacists
(1) A person, other than a pharmacist or a person acting under the personal
supervision of a pharmacist, must not dispense or compound any substance
specified in the Poisons List on the prescription of a medical practitioner, a
nurse practitioner, a midwife practitioner, an optometrist, a podiatrist, a
dentist or a veterinary practitioner.
: Maximum penalty--50 penalty units.
(2) Subsection (1) does not prevent--
(a) a medical practitioner, a nurse
practitioner, a midwife practitioner, an optometrist, a podiatrist, a dentist
or a veterinary practitioner from supplying a substance to which that
subsection refers in the ordinary course of his or her profession, or
(b) a
person from supplying a substance to which that subsection refers under, and
in accordance with the conditions of, an authority issued under this Act or
the regulations.
