32I Role of courts
(1) The Local Court does not have jurisdiction to determine an action for the
detention of goods brought by a claimant in connection with goods that are in
the possession of a licensee and to which a restoration notice relates,
unless: (a) the regulations otherwise provide, or
(b) the Tribunal does not
have jurisdiction to hear and determine an application for an order under
section 32G in relation to the goods, or
(c) the Tribunal has directed that
proceedings to hear and determine such an application be stayed on the ground
that the Tribunal does not have jurisdiction to make an order as sought
because of monetary limits on the jurisdiction of the Tribunal.
(2) If
proceedings for the recovery of pawned goods are commenced in any other court,
that other court may, without affecting any power vested in it, hear and
determine the proceedings in accordance with that section.
