50 Imposition of navigation service charge
(1) A navigation service charge is payable in respect of the general use by a
vessel of a designated port and its infrastructure, apart from: (a) the use of
a pilot, or
(b) the use of land-based port facilities and staff directly
involved in providing services at those facilities, or
(c) port access for
cargo at the interface between the vessel and land-based facilities for the
purpose of stevedoring operations.
(2) Unless the regulations otherwise
provide, the charge: (a) is payable on each entry by the vessel into any
designated port, and
(b) is to be calculated by reference to the gross
tonnage of the vessel.
(3) The charge is payable whether entry to the waters
of a port is by sea or from the land (or, in the case of a seaplane, from the
air).
(4) A navigation service charge is payable by the owner of the vessel
concerned.
