(1) The Environment Protection Authority may determine
an application for a licence by granting a licence to the applicant.
(2) The
Authority may refuse to grant a licence to an applicant for a licence--
(a) if
the Authority is of the opinion that the applicant is not a fit and proper
person to hold the licence, or
(b) if the applicant does not hold the
qualifications prescribed by, or determined in accordance with, the
regulations for the kind of licence, or
(c) if the applicant does not hold an
insurance policy of a class prescribed by the regulations (or is not eligible
to hold such a policy) for the licence concerned, or
(d) in such other
circumstances as may be prescribed by the regulations.
