Continuing effect of notices, orders and conditions
118A Continuing effect of notices, orders and conditions
(1) A notice given
or order made, or a condition of a licence or certificate of competency, under
this Act or the regulations that specifies a time by which, or a period within
which, it must be complied with continues to have effect until it is complied
with even though the time has passed or the period has expired.
(2) A notice
or order that does not specify a time by which, or period within which, the
notice or order must be complied with continues to have effect until the
notice or order is complied with.
(3) This section does not apply to the
extent that any requirement under a notice or order is revoked or a condition
of a licence or certificate of competency is revoked.
(4) Nothing in this
section affects the powers of the Environment Protection Authority with
respect to the enforcement of a notice or order.
(5) This section extends to
a condition of a licence or a certificate of competency in force on the
commencement of this section.
