Notice to be given of cause of danger
129 Notice to be given of cause of danger
(1) If an inspector finds any matter, thing or practice connected with the
operations conducted on any land subject to a petroleum title, or with the use
of any easement or right of way under this Act, to be so dangerous or
defective as in the inspector’s opinion to threaten or tend to injure the
health or body of any person, the inspector may: (a) give notice of that
finding in writing to the registered holder of the title or the manager of the
operations or to the person to whom the easement or right of way was granted,
and
(b) state in the notice the particulars in which the inspector considers
those operations to be dangerous or defective and require them to be remedied
within a period specified in the notice, and
(c) if the inspector thinks it
necessary, direct that the registered holder of the title, the manager of the
operations or the person to whom the easement or right of way was granted
cause the operations or any part of the operations to cease, or cause persons
on the land to be withdrawn, either indefinitely or for such period as is
specified in the notice by the inspector.
(2) A copy of the notice is to be
sent immediately by the inspector to the Minister.
