POLICE ACT 1990 - SECT 36
Appointments to executive positions
(1) Appointments to vacant executive positions are to be made: (a) by the
Governor on the recommendation of the Commissioner, in the case of
appointments to the position of Deputy Commissioner or Assistant Commissioner,
or
(b) by the Commissioner, in any other case.
(2) A recommendation referred
to in subsection (1) (a) may not be submitted to the Governor except with the
approval of the Minister.
(3) It does not matter whether the person appointed
is or is not already a member of the NSW Police Force.
(4) In particular, it
does not matter whether a person appointed to a position designated as a
position to be held by a police officer is or is not a police officer at the
time of appointment.
