(1) In the application of
Part 5 of Chapter 4 of the Industrial Relations Act 1996to proceedings under
this Division, the provisions of sections 163, 167, 169 (4), 172, 181 and 184
of that Act do not have effect.
(2) Proceedings under this Division are to be
dealt with by a member of the Commission who is an Australian lawyer unless
the Chief Commissioner otherwise directs under section 159 of the Industrial
Relations Act 1996 .
