Making of complaints to Commissioner

124 Making of complaints to Commissioner

(1) Any person may complain to the Commissioner about conduct of a police officer or administrative employee that is (or could be) police misconduct, administrative employee misconduct or officer maladministration.
(2) Any person may complain to the Commissioner about conduct of the NSW Police Force that is (or could be) agency maladministration.
(3) This section does not affect any other right of a person to complain about the conduct of an administrative employee or a police officer or the NSW Police Force.
Note : Protections may be available under the Public Interest Disclosures Act 2022 , Part 3, to persons who make a complaint referred to in this section, if the complaint is a public interest disclosure within the meaning of that Act.

Complaints may be made under other Acts, including the Law Enforcement Conduct Commission Act 2016 , section 35. Equivalent protections may also be available under other Acts to persons who make complaints--for example, where the making of the complaint is protected action within the meaning of--
(a) the Independent Commission Against Corruption Act 1988 , Part 8A, or
(b) the Ombudsman Act 1974 , Part 4B, or
(c) the Law Enforcement Conduct Commission Act 2016 , Part 6A.
