Consent to commencement or resumption of pipeline operations
25 Consent to commencement or resumption of pipeline operations
(1) The Minister, on application in writing served on him or her: (a) by a
licensee whose pipeline has not previously been in operation, or
(b) by a
licensee who has ceased to operate the pipeline specified in his or her
licence,
may, if he or she is of the opinion that the pipeline may be operated
with safety, by instrument in writing served on the licensee, consent to the
commencement or resumption, as the case may be, of operations.
(2) A consent
under subsection (1) may be given subject to such conditions, if any, as the
Minister thinks fit and specifies in the instrument of consent.
(3) The
Minister may, by instrument in writing, served upon a licensee, from time to
time vary any conditions subject to which a consent under subsection (1) was
given to that licensee or attach additional conditions to such a consent.
(4)
Any conditions to which a consent given to a licensee under subsection (1) is
from time to time subject shall, for the purposes of this Act, be deemed to be
conditions to which the licence held by that licensee is subject.
