Protecting the environment to be taken into account
38B Protecting the environment to be taken into account
(1) In deciding whether or not to grant or renew a licence, or to extend the
term of a licence, the Minister is to take into account the need to conserve
and protect: (a) the flora, fauna, fish, fisheries and scenic attractions in
the area concerned, and
(b) the features of Aboriginal, archaeological,
historical or geological interest of the area.
(2) The Minister may cause
such studies (including environmental impact studies) to be carried out as the
Minister considers necessary to enable such a decision to be made.
