Referral of objections to ADT at request of objector
34 Referral of objections to ADT at request of objector
(1) The body or person making a relevant native title objection may request
the relevant authority of the State to refer the objection to the Tribunal.
(2) Any such request: (a) must be in writing, and
(b) must identify the
proposed act, and
(c) must specify the reason for the objection, and
(d)
must comply with any other requirements of the regulations.
(3) Any such
request may be made at any time after the completion of the consultation on
the matter required by section 24MD (6B) (e) of the Commonwealth
Native Title Act and before the closing date determined by the relevant
authority of the State. The closing date is to be a date, notified in writing
to the body or person who has made the objection, that is at least 28 days
after the completion of that consultation or such later date to which the
relevant authority of the State agrees.
(4) If any such request is duly made
under this section, the relevant authority of the State must refer the
objection to the Tribunal unless it decides not to proceed with the proposed
act the subject of the objection.
