Satisfying other procedural rights of native title holders
103A Satisfying other procedural rights of native title holders
(1) This section applies if--
(a) because of any law of the Commonwealth or
the State, native title holders have a procedural right that requires another
person to do any thing in relation to the native title holders, and
(b) there
has been no approved determination of native title.
(2) One way in which the
person may give effect to the requirement is--
(a) by doing the thing in
relation to any registered native title claimant in relation to land or waters
in the area concerned, or
(b) if there are no such registered native title
claimants in relation to land or waters in the area concerned--by ensuring
that any representative Aboriginal/Torres Strait Islander bodies for the area
concerned have an opportunity to comment on the doing of the act.
Note : If
the doing of the thing is required for the purposes of complying with section
24KA, 24MD or 24NA NTA, the requirements of section 24KA (9), 24MD (8) or 24NA
(10) NTA apply.
