Satisfying right of native title holders to be notified of an act
103 Satisfying right of native title holders to be notified of an act
(1) This section applies if: (a) because of any law of the Commonwealth or the
State, native title holders have a procedural right that requires another
person to notify them of an act, and
(b) there has been no approved
determination of native title.
(2) One way in which the person may give the
required notice is by notifying in the approved manner the following that the
act is to take place: (a) any representative Aboriginal/Torres Strait Islander
bodies for the area concerned,
(b) any registered native title claimants in
relation to land or waters in the area concerned.
(3) The approved manner of
notification is: (a) the manner of notification prescribed by the law of the
Commonwealth or the State for notifying the holders of ordinary title of the
act concerned, or
(b) if there is no such manner of notification
prescribed-by post or in such other manner to which the notified body or
person agrees.
Note: If notification of the act is required for the purposes
of complying with section 24KA, 24MD or 24NA NTA, the notification
requirements of section 24KA (8), 24MD (7) or 24NA (9) NTA apply.
