Establishment of the Trust
4 Establishment of the Trust
(1) There is established by this Act a body corporate to be called The
National Trust of Australia (New South Wales), consisting of the persons who
under the rules are members of the Trust.
(2) The Trust is a continuation of,
and the same legal entity as, The National Trust of Australia (New South
Wales) constituted under The National Trust of Australia (New South Wales) Act
1960 .
(3) The Trust is to be considered to be a statutory body and a
statutory corporation for the purposes of the Interpretation Act 1987 but does
not represent the Crown.
(4) Nothing in this Act is to be taken to constitute
the Trust as a company for the purposes of any law, or previous law, of the
State relating to companies.
