MOTOR VEHICLE REPAIRS ACT 1980 - SECT 75B
Production of records
75B Production of records
(1) For the purpose of ascertaining whether a person is contravening or has
contravened this Act or the regulations, or Part 2AA of the
Road Transport (Vehicle Registration) Act 1997 or the regulations made under
that Part, an inspector may, orally or by instrument in writing, require the
person to produce specified records, or records of a specified class or
description, to a specified inspector at a specified time or within a
specified period.
(2) If an inspector requires production under this section
of a record that is not in writing, or is not written in the English language,
or is not decipherable on sight, the requirement to produce the record is
taken to be a requirement to produce, in addition to the record if it is in
writing, or instead of a record if it is not in writing, a statement written
in the English language and decipherable on sight, containing the whole of the
information in the record.
(3) An inspector may inspect and take notes,
copies and extracts of or from any record or statement produced under this
section.
(4) For the purpose of searching for, or obtaining information
concerning, stolen motor vehicles and stolen motor vehicle parts or
accessories, a police officer has the powers of an inspector under this
section.
(5) A person must not refuse or fail to produce any record or
statement in accordance with a requirement made under this section. Maximum
penalty: 20 penalty units.
(6) Nothing in this section limits the operation
of section 75.
