Conditions of, and restrictions on, licences and certificates
33 Conditions of, and restrictions on, licences and certificates
(1) The Authority may, on granting a licence or certificate or at any other
time, impose conditions or restrictions on the licence or certificate.
(2)
The Authority may, on the application of the holder or on the Authority’s
own motion, vary or revoke a condition or restriction imposed on a licence or
certificate.
(3) A licence or certificate is subject: (a) to any conditions
or restrictions prescribed by the regulations, and
(b) to any conditions or
restrictions imposed by the Authority under this section.
(4) The Authority
must not impose or vary a condition of or restriction on a licence or
certificate unless the Authority has first given the relevant applicant or
holder an opportunity to make submissions, orally or in writing, and adduce
evidence, with respect to the proposed condition or restriction or variation.
(5) Nothing in this section affects the exercise of powers by the Authority
under section 26.
(6) If a condition or restriction is imposed or varied
under this section on a current licence or certificate, the holder of the
licence or certificate must produce the licence or certificate to the
Authority, within the time specified by the Authority, for endorsement of the
condition or restriction. Maximum penalty (subsection (6)): 20 penalty units.
