(1) The Commissioner of Police or Transport for NSW may cause an impounded or
forfeited vessel to be offered for sale in the circumstances prescribed by the
regulations. The sale is to be by public auction or public tender.
(2) The
vessel may be disposed of otherwise than by sale if the Commissioner of Police
or Transport for NSW believes it is appropriate in the circumstances to
dispose of the vessel otherwise than by sale.
(3) If the vessel offered for
sale is not sold, the Commissioner of Police or Transport for NSW may dispose
of the vessel otherwise than by sale.
(4) The regulations may make provision
for or with respect to the disposal of the proceeds of any such sale,
including provisions for or with respect to entitling persons to seek to be
paid any such proceeds.
(6) Transport for NSW may cause any vessel released to it
to be used for the purposes of crash testing and any educational program for
operators of vessels established by Transport for NSW.
