MARINE SAFETY ACT 1998 - SECT 139
Exemptions
139 Exemptions
(1) The regulations may exempt, or provide for the exemption of, any person or
vessel from any requirement of the regulations.
(2) If this Act confers a
power to make regulations to exempt any person or vessel from a requirement of
this Act or the regulations, the power extends to making a regulation
authorising the Minister or other person to grant the exemption.
(3) An
exemption granted by the regulations, by a licence or approval as referred to
in section 18 or by an order of the Minister or other person may be made
subject to any condition specified in the regulation, licence, approval or
order.
(4) The exemption does not apply during any period that any such
relevant condition is not complied with.
Note: Sections 11, 18, 50, 53, 57
and 75 make provision for the granting of exemptions. Schedule 4 contains
provisions for the preservation of exemptions granted under the Acts repealed
by this Act.
