Ordering of investigations
103 Ordering of investigations
(1) The Minister may order an investigation into any one or more of the
following-- (a) a marine accident that has been reported under Division 2 or
that the Minister believes may have occurred,
(b) any situation that has the
potential to cause marine accidents,
(c) an incident in connection with a
port facility that have caused, or has the potential to cause, a danger to
life or serious damage to property.
(2) An investigation may be carried out
and a report provided to the Minister whether or not-- (a) an investigation is
being, or has been, conducted under the Passenger Transport Act 2014 or any
other Act or law relating to the same matter, or
(b) the matter is or may be
subject to any criminal or civil proceedings, or
(c) the matter is or may be
subject to an inquest or inquiry under the Coroners Act 2009 .
