Carrying uncategorised noxious liquid substances prohibited

27 Carrying uncategorised noxious liquid substances prohibited

(1) The master and the owner of an Australian ship are each guilty of an offence if an uncategorised noxious liquid substance, or a mixture that contains an uncategorised noxious liquid substance, is carried as cargo or part cargo in bulk on the ship in State waters.
: Maximum penalty--
(a) in the case of an individual--$6,600, or
(b) in the case of a corporation--$33,000.
(2) In proceedings for an offence against this section in relation to a ship it is sufficient for the prosecution to allege and prove that an uncategorised noxious liquid substance, or a mixture that contains an uncategorised noxious liquid substance, was carried as cargo or part cargo in bulk on the ship in State waters.
