MARINE PARKS ACT 1997 - SECT 20G
Offence provisions
20G Offence provisions
(1) A person who carries out any activity in contravention of a
marine park closure is guilty of an offence. Maximum penalty: In the case of a
corporation, 1,000 penalty units or, in any other case, 200 penalty units or
imprisonment for 6 months, or both.
(2) A person who is in possession of any
animal, plant, rock, sand or other thing that has been taken in contravention
of a marine park closure is guilty of an offence. Maximum penalty: In the case
of a corporation, 500 penalty units or, in any other case, 100 penalty units
or imprisonment for 3 months, or both.
(3) It is a defence to a prosecution
for an offence under subsection (2) if the person charged satisfies the court
that the person did not know and could not reasonably have known that the
animal, plant, rock, sand or other thing had been taken in contravention of a
provision of or made under this Act.
