Deregistration on basis of disciplinary action under foreign law
32 Deregistration on basis of disciplinary action under foreign law
(1) This section applies when it is proved to the satisfaction of that Board
that, after a person was registered under this Act, the person was
deregistered under a foreign law: (a) for any reason relating to conduct of
the person amounting to professional misconduct (within the meaning of this
Act), or
(b) for any reason relating to the person’s physical or mental
capacity to practise medicine.
(2) When this section applies and the foreign
law concerned is a law of a place in Australia, the Board must remove the name
of the person from the Register. If the foreign law is a law of a place
outside Australia, the Board may remove the name of the person from the
Register.
(3) The Board may restore any name so removed from the Register, if
it thinks it appropriate in the circumstances.
(4) For the purposes of this
section, a person is
"deregistered" under a foreign law when: (a) the person’s name is removed
from any register or roll under a foreign law, or
(b) the person’s
entitlement to practise medicine is suspended under a foreign law (in the case
of a person who is not entitled to registration under the Mutual Recognition
laws).
