MENTAL HEALTH (FORENSIC PROVISIONS) ACT 1990 - SECT 59
Review of persons transferred from correctional centres
(1) The Tribunal must review the case of a person transferred under this
Division to a mental health facility from a correctional centre as soon as
practicable after the person is so transferred and may make an order as to the
person’s continued detention, care or treatment in a mental health facility
or correctional centre.
(2) On a review, the Tribunal is to determine whether
the person is a mentally ill person who should continue to be detained in a
mental health facility.
(3) If a person is transferred under this Division
from a correctional centre to a mental health facility, the Tribunal may, at
any time, make an order that the person be transferred to a
correctional centre.
