MINE HEALTH AND SAFETY ACT 2004 - SECT 59

59 Supervisor must inform operator of non-compliance

(1) A supervisor at a mine must inform the operator of the mine if the supervisor is aware that the conduct of the mine does not conform with this Act or the regulations or the Work Health and Safety Act 2011 or the regulations under that Act.

(2) A failure by a supervisor to inform the operator under this section does not affect any liability of the operator under this Act or the regulations or under the Work Health and Safety Act 2011 or the regulations under that Act.
