MINE HEALTH AND SAFETY ACT 2004 - SECT 23
Chief Inspector may declare person as operator
(1) If it appears to the
Chief Inspector that there is no operator of a mine or no mine holder exists
in relation to a mine or class of mine, the Chief Inspector may declare, by
notice in writing, that a specified person, or a person who is a member of a
specified class of persons, is the operator of the mine or class of mines.
(2) Any such notice may specify the time from which the declaration takes
effect.
