Rehabilitation services to be provided promptly
38 Rehabilitation services to be provided promptly
(1) In the provision of rehabilitation services, a licensed insurer and the
Nominal Defendant shall, as far as practicable, ensure that those services are
provided to an injured person as soon as possible after an admission of
liability is made by the licensed insurer or Nominal Defendant.
(1A) If
rehabilitation services are provided to an injured person before an admission
of liability is made by the licensed insurer or Nominal Defendant, the
provision of those services shall not be taken to be an admission of
liability.
(2) It is a condition of an insurer’s licence that the insurer
must comply with this section.
