Provision of rehabilitation services
37 Provision of rehabilitation services
(4) If: (a) a person is assessed to be suitable for rehabilitation, and
(b)
the licensed insurer or Nominal Defendant agrees to provide the appropriate
rehabilitation services, and
(c) the person fails to accept the provision of
those services,
the person’s failure shall be taken into account for the
purposes of section 39.
(5) A licensed insurer has no responsibility for the
rehabilitation of an injured person whose claim has been settled or in
relation to whom a judgment has been entered except as provided by the terms
of any order referred to in section 81.
