146 Provisions applicable to claims concerning intermediate transport
accidents
(1) Parts 4, 4A, 5, 6, 9 and 10 apply to and in respect of a claim relating to
an intermediate transport accident in the same way as they apply to a claim
within the meaning of Part 5, subject to this section.
(2) A person who has
made a claim under the 1987 Act before the date of commencement of Part 2
which has not been determined before that date shall be taken to have complied
with section 43.
(2A) Notice of a claim to which subsection (2) applies
shall, for the purposes of section 52 (1) (as inserted by the Motor Accidents
(Amendment) Act 1989 ) be taken to have been given when the claim was made
under the 1987 Act.
(3) For the purposes of the application of section 52
(Time limitations on commencement of court proceedings), a reference to the
date on which the claim must be made shall be construed as a reference to the
date on which Part 2 commences.
