Granting of proposed lease if objection or proposal made
93 Granting of proposed lease if objection or proposal made
(1) If an objection to the granting of a proposed lease is duly made, the
lease must not be granted unless the objection is withdrawn or otherwise
resolved or is rejected by the Premier.
(a) any condition proposed under this Division (unless the proposal for the
inclusion of the condition is withdrawn or is rejected by the Premier) or, if
such a condition is modified, the condition as so modified, and
(b) any
condition directed by the Premier to be included in the lease.
(3) The
failure to include a condition in a proposed lease does not affect the
validity of the lease, but the Minister may, by instrument in writing, amend
the lease so as to include the condition omitted.
(4) Despite clause 12 of
Schedule 1B, a condition included in a proposed lease in accordance with a
direction of the Premier may only be varied with the concurrence of the
Premier.
