MINING ACT 1992 - SECT 60
Land on which private mining operations being carried on
60 Land on which private mining operations being carried on
(1) A mining lease may not be granted over any land: (a) if mining operations
for a privately owned mineral are being carried out on the land by or with the
consent of the owner of the mineral, and
(b) if the notice referred to in
section 8 (1) (a) and the security referred to in section 8 (1) (b) have each
been duly lodged with the Director-General,
except with the written consent of
the owner of the mineral.
(2) A written consent given under this section is
irrevocable.
(3) If a dispute arises as to whether or not this section
applies in a particular case, any party to the dispute may apply to the Land
and Environment Court for a determination of the matter.
