Application of Act to former minerals
387A Application of Act to former minerals
(1) This section applies to a substance that, having been prescribed by the
regulations as a mineral for the purposes of the definition of
"mineral" in the Dictionary at the end of this Act, ceases to be so
prescribed.
(2) This Act continues to apply to a substance to which this
section applies as if it were a mineral and any mining lease or mineral claim
in respect of the substance continues in force, subject to this Act.
(2A) The
holder of any such lease or claim remains bound by the conditions of the lease
or claim (including conditions requiring payment of royalty) in accordance
with this Act.
(3) This section does not operate so as to allow the renewal
or consolidation of a mining lease or mineral claim that relates only to a
substance to which this section applies.
