175A Unlawful entry to site of mineral claim
(1) Any person who, while in a mineral claims district, is found in or on any
land the subject of a mineral claim held by some other person is guilty of an
offence.
: Maximum penalty--
(a) except as provided by paragraph (b), 50
penalty units or imprisonment for 6 months, or both, or
(b) if, when found on
the land, the person is in possession of tools or equipment of a kind
generally used for the purposes of prospecting or mining, 100 penalty units or
imprisonment for 2 years, or both.
(2) It is a sufficient defence to a
prosecution under this section if the defendant establishes that he or she had
a reasonable excuse for being in or on the land concerned.
