MORATORIUM ACT 1932 - SECT 46
Notices
46 Notices
(1) Any notice required or authorised by this Act to be given shall be in
writing, and shall be sufficiently given: (a) if delivered personally,
(b) if
sent by post in a registered letter addressed to the person to whom it is to
be given, by name, at his place of abode or business last known to the person
giving the notice; and the notice shall be deemed to have been given at the
time when the registered letter would in the ordinary course be delivered,
(c) if given in the manner provided by section 109X of the Corporations
Act 2001 of the Commonwealth when the person to whom notice is to be given is
a company,
(d) in cases of notices required on any application to the court
in the manner directed by the court or prescribed by rules of court or by
regulations under this Act.
(2) Where a mortgagor or purchaser: (a) has
abandoned possession of the mortgaged or purchased property and his address is
unknown to the mortgagee or vendor, or
(b) is dead and there is no personal
representative within the State of New South Wales,
notice may be given to
such mortgagor, purchaser, or persons interested in the estate of the deceased
mortgagor or purchaser in the manner prescribed by regulations under this Act.
