Form of instalment contracts
10 Form of instalment contracts
(1) A vendor under an instalment contract, or the vendor’s agent, shall not
tender to a purchaser a copy of an instalment contract for the sale and
purchase of a lot unless the instalment contract is in the form, or one of the
forms, of instalment contract annexed to the trust deed relating to the
subdivision in which the lot is comprised.
(2) Within twenty-one days after
tendering a copy of the instalment contract to a purchaser, the vendor shall
deliver or cause to be delivered to the purchaser a counterpart of the
contract duly executed by the vendor or the vendor’s duly appointed
attorney, if: (a) the copy of the instalment contract so tendered has been
executed by the purchaser and has, within fourteen days after its having been
so tendered, been delivered to the vendor or the agent of the vendor, and
(b)
the purchaser has complied with all terms and conditions required by the
instalment contract to be complied with by the purchaser at or before the
delivery to the purchaser of the counterpart of the contract duly executed as
aforesaid.
