Right of appeal about early assessment of suitability for a compliance certificate
27 Right of appeal about early assessment of suitability for a compliance
certificate
(1) An applicant for a declaration of early assessment of suitability for a
compliance certificate may appeal to the Supreme Court against the refusal of
the designated local regulatory authority to make the declaration.
(2) The
Supreme Court may make any order it considers appropriate on the appeal,
including without limitation a declaration of early assessment of suitability
for a compliance certificate.
(3) A declaration made under this section is
binding on the designated local regulatory authority unless the applicant
failed to make a full and fair disclosure of all matters relevant to the
declaration sought.
