Non-compellability of certain witnesses
38A Non-compellability of certain witnesses
(1) A person referred to in
section 601 (Protection from liability) is not compellable in any legal
proceedings to give evidence or produce documents in respect of any matter in
which the person was involved in the course of the administration of this
Part.
(2) This section does not apply to: (a) proceedings under Part 3 of the
Royal Commissions Act 1923 , or
(b) proceedings before the Independent
Commission Against Corruption, or
(c) a hearing under the Special Commissions
of Inquiry Act 1983 , or
(d) an inquiry under the Ombudsman Act 1974 .
