Compensation for improvements made before withdrawal
65 Compensation for improvements made before withdrawal
(1) The Minister
administering the Crown Land Management Act 2016 is liable to pay
compensation to Local Land Services for any improvements made to land
comprising any part of a travelling stock reserve that is withdrawn from the
care, control and management of Local Land Services.
(2) The compensation
must not exceed the current value of the improvements.
(3) If the Minister
administering the Crown Land Management Act 2016 and Local Land Services are
unable to agree on the amount of compensation, either of them may refer the
matter to the Civil and Administrative Tribunal for determination.
(4) If a
matter is referred to the Civil and Administrative Tribunal, the Tribunal must
determine the amount of compensation payable.
(5) The Civil and
Administrative Tribunal's determination is binding on the Minister and
Local Land Services.
