Offence to damage stock watering place
113 Offence to damage stock watering place
(1) A person must not
intentionally or recklessly pollute or, without lawful authority, interfere
with any water that flows into, or that is used as, the source of supply for
any stock watering place.
: Maximum penalty--100 penalty units.
(2) If any
person pollutes or, without lawful authority, interferes with any water that
flows into, or that is used as, the source of supply for a stock watering
place, the relevant controlling authority may recover from the person an
amount equal to the cost of cleaning up or removing the pollution or
interference as a debt due in a court of competent jurisdiction.
(3)
Proceedings may be brought under subsection (2) irrespective of whether
proceedings could be or have been brought for an offence under subsection (1)
arising out of the same matter.
