LAKE ILLAWARRA AUTHORITY ACT 1987 - SECT 16
Appeals
16 Appeals
(1) An applicant for a consent under section 14 who is aggrieved: (a) by any
decision of the Authority on the application, or
(b) by any neglect or delay
by the Authority to give, within 40 days after the application was lodged with
the Authority, a decision with respect to it,
may appeal to the Land and
Environment Court within the prescribed time or such longer period as that
Court may in special circumstances allow.
(2) In this section:
"prescribed time" means the period of 12 months commencing: (a) when the
applicant receives notice of the decision appealed against, or
(b) where
appropriate-when the period of 40 days after the application was lodged with
the Authority expires.
