LOCAL GOVERNMENT (CITY OF SYDNEY BOUNDARIES) ACT 1967 - SECT 9
Vacation of office
9 Vacation of office
(1) A Commissioner shall be deemed to have vacated his office: (a) if he dies,
(b) if he becomes bankrupt, compounds with his creditors, or makes any
assignment of any salary, remuneration or allowances payable to him, or of his
estate, for their benefit,
(c) if without leave granted by the Minister he
absents himself from four consecutive meetings, convened pursuant to
subsection two of section ten, or subsection two of section fifteen, of this
Act, of the Commissioners,
(d) if he becomes a mentally ill person, a
protected person or an incapable person within the meaning of the Mental
Health Act 1958 , as amended by subsequent Acts,
(e) if he or she is
convicted in New South Wales of an indictable offence that is punishable by
imprisonment for 12 months or more or is convicted elsewhere than in New South
Wales of an offence that, if committed in New South Wales, would be an offence
so punishable,
(f) if he resigns his office by writing under his hand
addressed to the Governor and his resignation is accepted by the Governor,
(g) if he is removed from office by the Governor.
(2) The Governor may, for
any cause which appears to him sufficient, remove any Commissioner from
office.
