LOCAL GOVERNMENT (NEWCASTLE FRUIT AND VEGETABLE MARKET) ACT 1972 - SECT 4
No other wholesale market permitted within Newcastle marketing district
(1) Where, on and after the appointed day, the Council provides within its
area a public market for the sale by wholesale of fruit and vegetables, the
power conferred by subsection one of section four hundred and fifty-four of
the Principal Act upon any council the area of which is within the
Newcastle marketing district is suspended for the period of twenty-five years
that next succeeds the appointed day in so far as it authorises such a council
to provide, manage and control within that district any other public market
for the sale by wholesale of fruit and vegetables other than
exempt fruit and vegetables.
(2) No person shall, during the period of
twenty-five years that next succeeds the appointed day: (a) establish any
public market within the Newcastle marketing district for the purpose of
selling by wholesale fruit and vegetables other than
exempt fruit and vegetables, or
(b) expand any public market used for that
purpose immediately before that day within the areas that, on and after that
day, comprise that district.
Penalty: Five hundred dollars and for each day
upon which the offence continues, one hundred dollars.
(3) Without prejudice
to the operation of subsection one of this section, subsection two of this
section does not apply to or in respect of a council referred to in subsection
one of this section.
