LOCAL GOVERNMENT ACT 1993 - SECT 626
Failure to obtain approval
626 Failure to obtain approval
(1) A person who carries out an activity
specified in Part A of the Table to section 68 without having obtained a prior
approval of the council under Part 1 of Chapter 7 required for the carrying
out of that activity is guilty of an offence, subject to subsection (2).
Maximum penalty: 50 penalty units (in the case of an individual) or 100
penalty units (in the case of a corporation).
(3) A person who carries out an
activity specified in Parts B-F of the Table to section 68 without having
obtained a prior approval of the council under Part 1 of Chapter 7 required
for the carrying out of that activity is guilty of an offence. Maximum
penalty: 20 penalty units.
(4) A person: (a) who carries out an activity
without having obtained a prior approval of the council under Part 1 of
Chapter 7 required for the carrying out of that activity, and
(b) who so
carries out the activity on the basis of an exemption granted by or under this
Act, being an exemption that is subject to conditions, and
(c) who carries
out the activity otherwise than in accordance with the conditions to which the
exemption is subject,
is guilty of an offence under subsection (1) or (3) as
if the exemption did not apply.
