New South Wales Consolidated ActsWhere two or more persons are liable for the same contribution payable in respect of any land, they shall each be liable for the whole of that contribution, but any one of them who has paid the contribution:
(a) may recover from any other person jointly liable with him or her an amount which bears to the amount of contribution so paid the same proportion as the value of the estate or interest in the land of such other person bears to the sum of the values of the estates or interests in the land of all persons liable for that contribution, and
(b) may:(i) sue for that firstmentioned amount in any court of competent jurisdiction as money paid to the use of that other person at his or her request, or(ii) retain or deduct that firstmentioned amount out of any moneys in his or her hands belonging or payable to that other person.
