Fees in respect of assigned matters
39 Fees in respect of assigned matters
(1) The Commission shall determine the fees to be paid by it to
private legal practitioners to whom work is assigned by the Commission.
(2)
In determining the fees referred to in subsection (1), the Commission shall
consult with and take into account the views of: (a) the Bar Association in
respect of fees to be paid to barristers, and
(b) the Law Society in respect
of fees to be paid to solicitors.
(3) The fees referred to in subsection (1)
shall, so far as practicable, consist of fixed amounts determined in respect
of particular legal services.
(4) A fee determined under subsection (1) in
respect of a legal service shall be less than the ordinary professional cost
of the legal service.
(5) In determining fees under subsection (1), the
Commission is subject to the requirements of any agreement or arrangement
under section 72A.
