60 Compensation to relatives
(1) This section applies to a cause of action for damages which arises (or
which would arise, but for the expiration as against the deceased of a
limitation period before or after the commencement of this Act) under
section 3 of the Compensation to Relatives Act of 1897 by virtue of the death
of a person caused by a wrongful act neglect or default.
(2) Where, on
application to a court by a person claiming to have a cause of action to which
this section applies, it appears to the court that--
(a) any of the material
facts of a decisive character relating to the cause of action of the deceased
in respect of the wrongful act neglect or default was not within the means of
knowledge of the deceased at any time before the year next preceding the death
of the deceased, and
(b) there is evidence to establish the cause of action
which the applicant claims to have, apart from the expiration as against the
deceased of a limitation period,
the court may order that the expiration as
against the deceased of a limitation period for a cause of action by the
deceased in respect of the wrongful act neglect or default have no effect in
relation to the cause of action which the applicant claims to have and
thereupon, for the purposes of an action brought by the applicant in that
court on the cause of action which the applicant claims to have, that
expiration has no effect.
(3) Where, by virtue of this section, the
expiration as against the deceased of a limitation period for a cause of
action by the deceased in respect of a wrongful act neglect or default has no
effect in relation to a cause of action to which this section applies, and the
person against whom the lastmentioned cause of action lies brings an action
for contribution under subsection (1) of section 5 of the Law Reform
(Miscellaneous Provisions) Act 1946 , the expiration as against the deceased
of a limitation period for a cause of action by the deceased in respect of a
wrongful act neglect or default has no effect in relation to the action for
contribution.
