Functions of Industrial Committee
199 Functions of Industrial Committee
(1) The functions of the Commission
under this Act with respect to a matter may be exercised in accordance with
this Act by an Industrial Committee, but only in respect of the industry (or
part of the industry) for which the Committee is established.
(2) Any such
function may be so exercised only if: (a) the matter is allocated to the
Committee by the President of the Commission, or
(b) application for the
exercise of the function in respect of the matter is made to the Committee by:
(i) any employer in the industry (or part of the industry) for which the
Committee is established or any industrial organisation of such employers, or
(ii) an industrial organisation of employees in the industry (or part of the
industry) for which the Committee is established.
(3) Any function so
exercised is taken to have been exercised by the member of the Commission who
is the Chairperson sitting alone.
(4) An Industrial Committee is not to
exercise a function if the Commission has directed that proceedings before the
Committee on the matter be discontinued.
(5) This section does not apply to a
function that may only be exercised by the Commission in Court Session.
