HEALTH RECORDS AND INFORMATION PRIVACY ACT 2002 - SECT 31
Private sector person may require evidence of identity or authority
31 Private sector person may require evidence of identity or authority
(1)
Before a private sector person provides access to health information to a
person, the private sector person must take reasonable steps to be satisfied
about that person’s authority to have access to the information.
(2) For
this purpose, the private sector person may require evidence of: (a) the
person’s identity, and
(b) if person seeking access claims to be authorised
to have access to the information under section 26 (2), the authority of that
person, and
(c) if the person seeking access claims to be an
authorised representative of the individual to whom the information relates,
the authority of that person.
Note: The term
"authorised representative" is defined in section 8.
